Wave of Protests After Grand Jury Doesn’t Indict Officer in Eric Garner Chokehold Case
This and the Mike Brown case in Ferguson illustrate a structural flaw in prosecuting cases against police officers. A grand jury generally acts as the prosecutor leads and asks them to do. The regular DA/prosecutor works with the police department regularly and often will have a conscious or unconscious bias in favor of police officers. So in all cases of death or serious injury in problematic circumstances, a special prosecutor should be appointed to handle the case.
